Probate/Letters of Administration Fees*
*Grant of Probate - This is the document which enables the Executor/s to deal with an estate where there is a valid Will
*Letters of Administration - This is the document which allows the Administrator to deal with the estate of a person who has died intestate (without a will)
ESTATES WHERE NO INHERITANCE TAX ACCOUNT IS REQUIRED
Grant of Probate/Letters of Administration only - Legal Fees of between £500 - £800 + VAT + Disbursements**
To obtain the Grant of Probate / Letters of Administration only, on an Estate where a full Inheritance Tax Account is not required and where the Executors/Administrators provide all asset information and deal with the subsequent administration we will:
- Draft the oath/statement of Truth
- Complete the Application Form
- Obtain the Grant
- Provide the Executor / Administrator with the Grant and sealed copies
Full Administration of the Estate - If we are instructed to carry out Full Administration of the Estate the legal fees will be between - £2,000 - £4,000 + VAT + Disbursements
In addition to obtaining the Grant of Probate as detailed above we will:
- Arrange the closure of Bank Accounts
- Arrange the calling in / transfer of other assets (not including Shares)
- Settle liabilities
- Prepare the Estate Accounts for Executor/Administrator approval
- Distribute the estate in accordance with the Will/Intestacy rules
ESTATES WHERE INHERITANCE TAX IS DUE OR A FULL INHERTIANCE TAX ACCOUNT IS REQUIRED
Grant of Probate/Letters of Administration - To obtain the Grant of Probate / Letters of Administration for a more complex estate where there is a valid Will which is not contested and assets include Shares and Bonds our fee will be charged on a percentage basis of between 1 - 1.5% of the gross value of the estate + VAT + Disbursements and we will;-
- Draft the Oath or Statement of Truth
- Complete IHT form 400 and all necessary subsidiary forms using the information provided by the Executor/administrator
- Deal with HMRC in relation to the inheritance tax position
- Obtain the Grant of Probate / Letters of Administration
- Arrange payment of IHT from estate assets
Full Administration of the Estate - In addition to the above, if we are instructed to deal with the administration of the estate our fee will be charged on a percentage basis of between 1.5% - 2% of the gross value of the estate + VAT + Disbursements
In addition to the points above we will:
- Arrange the closure of Bank Accounts
- Arrange the calling in / transfer / sale of other assets (but not including any Property)
- Settle liabilities
- Prepare the Estate Accounts for Executor/Administrator approval
- Distribute the estate in accordance with the Will / Intestacy Rules
Please note any conveyancing work involved in the Estate Administration will be charged in accordance with the Conveyancing section of our website.
**We will incur disbursements on your behalf when obtaining the Grant and/or dealing with the Administration of the Estate, these are payments made to third parties and will/may include the following:
